Your AICIS Review Starts With the Ingredients"},"content":{"rendered":"<div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"background-color: rgba(255,255,255,0);background-position: center center;background-repeat: no-repeat;border-width: 0px 0px 0px 0px;border-color:#e2e2e2;border-style:solid;\" ><div class=\"fusion-builder-row fusion-row fusion-flex-align-items-flex-start\" style=\"max-width:1352px;margin-left: calc(-4% \/ 2 );margin-right: calc(-4% \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-flex-column\"><div class=\"fusion-column-wrapper fusion-flex-justify-content-flex-start fusion-content-layout-column\" style=\"background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;padding: 0px 0px 0px 0px;\"><div class=\"fusion-text fusion-text-1\"><p>If you import industrial chemicals into Australia for commercial purposes \u2014 either on their own or as ingredients in finished products \u2014 you need to deal with the <a href=\"https:\/\/www.industrialchemicals.gov.au\/\">Australian Industrial Chemicals Introduction Scheme (AICIS)<\/a>.<\/p>\n<p>The mistake we see most often is treating AICIS as a product registration exercise.<\/p>\n<p>It isn&#8217;t.<\/p>\n<p>If you import a <a href=\"https:\/\/argylllaw.com\/industries\/cosmetics-cleaning-products-and-industrial-chemicals\/\">cosmetic, cleaning product, lubricant or other formulation<\/a> containing a number of industrial chemical ingredients, AICIS looks at the individual chemical introductions. Each relevant industrial chemical ingredient needs to be considered separately.<\/p>\n<p>That misunderstanding becomes expensive when it is discovered after the goods have been shipped. We have seen shipments held at the Australian border for months while the chemical ingredients and their AICIS status are worked through.<\/p>\n<p>By then, freight has been paid, customers are waiting and the Australian launch is already under pressure.<\/p>\n<p>The better time to establish the AICIS position is before your first commercial shipment.<\/p>\n<h2>What does AICIS regulate?<\/h2>\n<p>AICIS regulates the import and manufacture of industrial chemicals in Australia.<\/p>\n<p>Industrial chemicals include chemicals used in cosmetics, soaps, cleaning products, paints, inks, adhesives, lubricants, plastics and many other commercial and consumer applications.<\/p>\n<p>AICIS regulates the <b>industrial chemical being introduced<\/b>, rather than the finished formulation as a single regulatory item. For a mixture or product containing more than one industrial chemical, the introduction of each relevant chemical needs to be categorised separately.<\/p>\n<p>Take a cosmetic containing 20 industrial chemical ingredients. You are not asking whether \u201cthe cosmetic\u201d is on the Australian Inventory of Industrial Chemicals. You need to establish the Australian position for the individual industrial chemical ingredients in the formulation.<\/p>\n<p>The same principle applies where one ingredient appears across several of your products.<\/p>\n<p>Before you start looking at the Australian Inventory or AICIS introduction categories, you therefore need reliable chemical identity information for the formulation.<\/p>\n<p>A product name, trade name, INCI name or overseas marketing description does not necessarily give you the information needed to search the Inventory. AICIS recommends searching by CAS number or CAS name.<\/p>\n<h2>Which chemicals fall under AICIS?<\/h2>\n<p>AICIS regulates chemicals introduced for industrial use.<\/p>\n<p>Chemicals introduced solely for <a href=\"https:\/\/argylllaw.com\/tga-approval-process-for-overseas-manufacturers\/\">therapeutic use<\/a>, agricultural or veterinary use, <a href=\"https:\/\/argylllaw.com\/importing-food-products-into-australia\/\">food<\/a> or animal feed are dealt with under the relevant specialist regulatory regime rather than AICIS. To learn more about which regulatory regimes might apply to your product, see our video:<a href=\"https:\/\/argylllaw.com\/videos\/which-regulatory-bodies-govern-your-products-in-australia\">Which regulatory bodies govern your products in Australia?<\/a><\/p>\n<p>Cosmetic ingredients, cleaning chemicals, paints, adhesives, inks, lubricants and many other chemicals used in household and commercial products fall within industrial use.<\/p>\n<p>You therefore need to establish the intended Australian use before working through the AICIS position.<\/p>\n<p>The same chemical can have different uses. If you introduce it for an industrial use, the industrial introduction needs to comply with AICIS even if that chemical is also used for a therapeutic or other non-industrial purpose elsewhere.<\/p>\n<h2>We already sell the product in Europe or the United States. Is that enough?<\/h2>\n<p>No.<\/p>\n<p>Australia has its own regulatory system for industrial chemicals.<\/p>\n<p>European or US compliance does not establish the Australian position. An overseas registration or assessment does not replace the work required under AICIS.<\/p>\n<p>Your overseas regulatory work is still valuable. Chemical identity, composition, concentration, hazard data, intended use and existing assessment information provide useful information for the Australian review.<\/p>\n<p>But Australia has its own Inventory, its own introduction categories and its own requirements.<\/p>\n<p>If your regulatory team has already completed the European or US work, use that information as the starting point for the Australian review \u2014 not as evidence that the Australian requirements have been satisfied.<\/p>\n<p>AICIS recognises specified overseas assessments under particular pathways. It does not adopt overseas registrations wholesale.<\/p>\n<p>So a product that has been successfully sold in Europe or the United States for years still needs an Australian AICIS review before you start importing its industrial chemical ingredients into Australia.<\/p>\n<h2>Who is responsible for AICIS compliance in Australia?<\/h2>\n<p>You need to establish who the introducer is before your first shipment.<\/p>\n<p>The introducer is the person or business importing the industrial chemical into Australia or manufacturing it here.<\/p>\n<p>If your Australian distributor or agent imports your products, that Australian business is the introducer. It registers with AICIS and is responsible for the compliance and reporting obligations for those introductions.<\/p>\n<p>If your overseas company imports directly into Australia, different registration arrangements apply. A foreign business registering directly with AICIS needs to either <a href=\"https:\/\/argylllaw.com\/services\/foreign-subsidiary-in-australia\/\">set up an Australian subsidiary<\/a> to hold that registration or get an Australian Registered Body Number (ARBN) as the introducer must be an Australian resident entity or individual.<\/p>\n<p>This should be settled when you establish your Australian distribution and import arrangements.<\/p>\n<p>It also has a practical consequence. The introducer needs access to enough information to establish and support the AICIS position for the chemical introductions.<\/p>\n<p>That becomes difficult if the Australian distributor is expected to take responsibility for AICIS compliance but does not know the chemical identity or concentration of ingredients in a confidential overseas formulation.<\/p>\n<h2>If the importer is registered with AICIS, are we covered?<\/h2>\n<p>No.<\/p>\n<p>This is the second misconception worth clearing up.<\/p>\n<p><b>You register the introducer. Registration does not approve the chemicals being introduced.<\/b><\/p>\n<p>AICIS itself describes registration as registration of the business, not of products or chemicals.<\/p>\n<p>After registration, the introducer still needs to establish the correct AICIS category for each industrial chemical introduction.<\/p>\n<p>The five main categories are:<\/p>\n<ul>\n<li>listed;<\/li>\n<li>exempted;<\/li>\n<li>reported;<\/li>\n<li>assessed; and<\/li>\n<li>commercial evaluation.<\/li>\n<\/ul>\n<p>Each category has its own requirements.<\/p>\n<p>So if your Australian distributor tells you, \u201cWe&#8217;re AICIS registered\u201d, that answers one question.<\/p>\n<p>It does not answer the next one:<\/p>\n<p><b>What is the AICIS position for each industrial chemical ingredient we are importing?<\/b><\/p>\n<h2>What if the chemical is already on the Australian Inventory?<\/h2>\n<p>Finding a chemical on the Australian Inventory of Industrial Chemicals is a good start.<\/p>\n<p>It does not end the review.<\/p>\n<p>For an introduction to qualify as listed, the chemical must be on the Inventory and the proposed introduction must comply with the terms of that Inventory listing. Those terms include conditions, defined scopes of assessment and other regulatory requirements for particular chemicals.<\/p>\n<p>You therefore need to check the Inventory record itself rather than stop when the chemical name appears in the search results.<\/p>\n<p>A listing does not amount to unrestricted permission to introduce the chemical in every use, concentration or circumstance.<\/p>\n<h2>What if the chemical is not on the Inventory?<\/h2>\n<p>A chemical that does not appear on the Inventory is not automatically prohibited.<\/p>\n<p>It means you need to establish another basis on which the introduction is authorised under AICIS.<\/p>\n<p>The correct category depends on the chemical and the proposed Australian introduction. AICIS categorisation takes account of factors including the chemical&#8217;s hazards and the circumstances of the introduction, including use, concentration and exposure.<\/p>\n<p>This is where overseas businesses sometimes run into trouble. A familiar ingredient, a low concentration or a long history of overseas use does not, by itself, answer the Australian categorisation question.<\/p>\n<p>The introducer is responsible for getting the categorisation right.<\/p>\n<p>AICIS provides detailed guidance and decision tools, but it expressly states that it does not categorise chemical introductions for businesses or confirm that a categorisation is correct.<\/p>\n<h2>What information do you need from the overseas manufacturer?<\/h2>\n<p>For imported formulations, some of the information required for the AICIS review is often held by the overseas manufacturer or by your ingredient supplier.<\/p>\n<p>Chemical identity is particularly important.<\/p>\n<p>The Australian introducer needs enough information to establish the AICIS position for each relevant industrial chemical ingredient. The information required then depends on the introduction.<\/p>\n<p>Confidential formulations create an obvious problem. A manufacturer or supplier is usually unwilling to disclose proprietary chemical information to an Australian introducer.<\/p>\n<p>AICIS has arrangements for overseas manufacturers and other chemical data providers where confidential information needs to be protected.<\/p>\n<p>This should be organised before shipment.<\/p>\n<p>If the Australian introducer does not have the information needed to support the AICIS position, discovering that after the goods arrive in Australia is a very frustrating way to find out.<\/p>\n<h2>Do the obligations stop after the first shipment?<\/h2>\n<p>No.<\/p>\n<p>AICIS imposes ongoing obligations on introducers, including record keeping and annual declarations. Other reporting obligations apply to particular introduction categories.<\/p>\n<p>The introducer also needs records supporting the category under which each chemical was introduced.<\/p>\n<p>Changes to an introduction require further attention. A change in use, concentration, volume or exposure alters the facts on which the original AICIS position was based.<\/p>\n<p>AICIS compliance therefore needs to be maintained as your Australian business develops, rather than treated as a one-off exercise completed before the first shipment.<\/p>\n<h2>Before your first shipment<\/h2>\n<p>Before you send products containing industrial chemicals to Australia, you should be able to answer two questions confidently:<\/p>\n<p><b>Do we know the Australian AICIS position for each industrial chemical ingredient we intend to introduce?<\/b><\/p>\n<p><b>Do we know who is responsible in Australia for complying with it?<\/b><\/p>\n<p>If you do not have clear answers to both questions, deal with them before you ship.<\/p>\n<p>An AICIS registration alone does not answer them.<\/p>\n<p>Neither does approval or registration in Europe or the United States.<\/p>\n<p>And looking at the finished product instead of the individual industrial chemical ingredients starts the review in the wrong place.<\/p>\n<p>The practical benefit of resolving these issues early is straightforward: you have time to obtain chemical information, address confidentiality, determine the correct introduction category and make sure the Australian importer has what it needs before the goods are on their way.<\/p>\n<p>That is a far better position than trying to sort out the same questions while a shipment is being held at the border.<\/p>\n<h2>How Argyll Law helps<\/h2>\n<p>Before you commit to your first shipment, we help you establish the Australian position for the industrial chemicals you intend to introduce.<\/p>\n<p>We work with overseas manufacturers and Australian importers to identify the relevant industrial chemical ingredients, determine who has the AICIS obligations and work through the regulatory position for the proposed introductions.<\/p>\n<p>We also deal with the commercial arrangements around the import. If an Australian distributor is the introducer, the distribution agreement, access to chemical information and responsibility for ongoing AICIS compliance need to reflect that arrangement.<\/p>\n<p>We regularly see the same problem: a business has concentrated on whether its are compliant and has not established the AICIS position for the individual ingredients.<\/p>\n<p>Finding that out before shipment is usually straightforward to manage.<\/p>\n<p>Finding it out when your stock is already at the Australian border is a very different experience.<\/p>\n<p>We\u2019re genuinely pleased if you\u2019ve found this resource useful.
